Product Information
The customer intends to purchase the specific product(s) selected in-cart or in-store, at the total price shown at checkout or on the in-store order form.
Layaway Terms
- Deposit. The customer acknowledges the obligation to remit a deposit of 25% of the total product price upon signing this Agreement.
- Payment Plan. The customer acknowledges the obligation to pay the remaining balance in installments, with a payment amount, due dates and final payment due date agreed upon at signing.
- Total Amount Due. The total price of the layaway item(s), as shown at checkout or on the in-store order form.
- Layaway Duration. The duration of this layaway program is 45 days from the date of this Agreement. Should the customer desire to extend the layaway period to 60 days, a 25% APR increase will be applied to the remaining balance.
- Payment Method. Payments may be made via credit card, debit card, cash, or another method arranged with the store.
- Cancellation and Refund Policy. This layaway program is non-refundable. Should the customer choose to cancel the layaway Agreement prior to its completion, all amounts paid, including the deposit, will be forfeited.
- Ownership and Transfer. Ownership of the item will remain with Exclusive Essence until the total price is paid in full. This Agreement is non-transferable.
- Default. If the customer fails to make a scheduled payment, Exclusive Essence reserves the right to cancel the layaway Agreement. All funds paid, including the deposit, will be forfeited.
- Compliance with Ohio Law. This Agreement is governed by and construed in accordance with the laws of the State of Ohio, including all applicable Ohio Revised Code provisions and consumer protection laws related to layaway agreements.
- Agreement Signatures. By signing this Agreement, both parties acknowledge that they have read, comprehended and consented to the terms and conditions set forth herein.
